Terms of Use & License (EULA)

This End User License Agreement (EULA) governs the use of the KajaApp mobile application, including its auto-renewing subscription plans. We recommend reading it carefully before subscribing.
Purpose and Acceptance
These Terms of Use and End User License Agreement ("EULA") govern access to and use of the KajaApp mobile application (the "App"), developed and operated by e4code (Ecuatro Code). By downloading, installing or using the App, you ("the User") agree to be bound by this EULA in full.
If you do not agree with any provision of this document, you must refrain from downloading, installing or using the App. Continued use of the App implies acceptance of this EULA and its future updates.
This EULA complements, and does not replace, the KajaApp Privacy Policy, available in the link at the end of this document.
Service Description
KajaApp is a point-of-sale (POS) application for counter businesses that allows managing a product catalog, charging sales with different payment methods, generating digital receipts, tracking inventory and obtaining operational reports.
e4code may modify, improve or discontinue App features at any time, in order to improve the service, fix bugs, or comply with legal requirements or those of the distribution platforms (App Store, Google Play).
The App's correct operation depends on a stable internet connection and the compatibility of the User's device with the minimum requirements published in the app store.
User Account
To use KajaApp, the User must create an account by providing truthful, accurate and up-to-date information. The User is responsible for keeping their access credentials confidential.
The User must have legal capacity to contract and be of legal age under the laws of their country of residence, or hold authorization from the legal entity (business) on whose behalf the account is managed.
e4code reserves the right to suspend or cancel accounts that violate this EULA, provide false information, or use the App fraudulently or contrary to the law.
Plans and Pricing
KajaApp offers three auto-renewing subscription plans, billed monthly: Basic (USD $19.49/mo), Pro (USD $38.99/mo) and Elite (USD $64.99/mo). The features included in each plan are shown in the Pricing section of this page and within the App.
Exact prices, applicable taxes and billing currency are shown on the App Store or Google Play purchase screen before confirming the subscription, and may vary by the User's region. e4code may update plan prices, notifying such changes with the advance notice required by the corresponding app store.
When the subscription is purchased from the iOS or Android App, the purchase is processed through Apple's or Google's In-App Purchase system, and payment will be charged to the account associated with the User's device at the time the purchase is confirmed.
Auto-Renewal
KajaApp subscriptions renew automatically at the end of each monthly period, unless the User disables auto-renewal at least 24 hours before the current period ends.
The User's account will be charged the renewal amount within 24 hours prior to the end of the current period, for an amount equal to the price identified for the plan contracted at the time of renewal.
By confirming the purchase, Apple's or Google's payment system authorizes the subscription charge to the account associated with the User's device.
Cancellation and Subscription Management
The User can manage or cancel their subscription at any time from their Apple ID or Google Play account settings, in the Subscriptions section of their device.
Cancelling auto-renewal must be done at least 24 hours before the end of the current billing period to avoid a new charge. Cancellation does not generate refunds for the period already started.
Cancelling the subscription does not delete the account or the business data; access to the paid plan's features remains until the end of the already-billed period, after which the account moves to a limited or read-only state.
Free Trial
If KajaApp offers a free trial period for a plan, any unused portion of that period will be forfeited once the User purchases the corresponding paid subscription, in accordance with the app store's policies.
Refunds
When the subscription is purchased through the App Store or Google Play, refund requests are handled directly with Apple or Google, according to their refund policies, since e4code does not process or have access to the User's payment data.
e4code does not guarantee the approval of refund requests submitted to Apple or Google, as this is a decision made exclusively by those platforms.
Intellectual Property
KajaApp, its source code, design, brand, logos and content are the property of e4code or its licensors, and are protected by intellectual property laws. This EULA does not transfer any ownership rights over the App to the User.
The User is granted a limited, non-exclusive, non-transferable and revocable license to install and use the App on devices they own or control, solely for the purposes intended by KajaApp.
Reverse engineering, decompiling, copying, modifying or unauthorized distribution of the App is prohibited, except to the extent permitted by applicable law.
Acceptable Use
The User agrees to use KajaApp lawfully, refraining from entering false data, interfering with the App's operation, breaching security measures, or using it for purposes other than managing their business.
Use of the App for fraudulent activities, unauthorized resale of the service, or any conduct that infringes third-party rights or applicable regulations is prohibited.
Limitation of Liability
KajaApp is provided "as is" and "as available". e4code does not guarantee that the App will be free of errors or interruptions, although it will make reasonable efforts to maintain its availability and correct operation.
To the maximum extent permitted by law, e4code's liability to the User is limited to the amount paid for the subscription during the last three (3) months, and does not include indirect damages, lost profits or data loss arising from use of the App.
Apple and Google have no obligation whatsoever to provide maintenance or support for the App. Any claim related to the App, its content, or the failure to meet any warranty must be directed to e4code and not to those platforms.
Termination
e4code may suspend or terminate the User's access to the App in case of a breach of this EULA, without prejudice to subscriptions already billed by the corresponding app store.
The User may stop using the App and delete their account at any time from the corresponding section within the App, without this automatically canceling the active subscription, which must be canceled separately.
Changes to these Terms
e4code may modify this EULA to reflect changes in the App, app store requirements, or applicable regulations. Substantial changes will be notified within the App or published on this page with a visible update date.
Continued use of the App after changes are published implies acceptance of the updated version of this EULA.
Governing Law
This EULA is governed by the laws of the Republic of Ecuador. Any dispute related to the App that is not resolved directly with Apple or Google under their policies will be submitted to the competent courts of the city of Quito, Ecuador.
